INTRODUCTION
Welcome to the terms and conditions of the Old Villa website shop. Old Villa Limited is a limited company registered in England and Wales at 143 Lordship Lane, London SE22 8HX, under registration number 07002406 and operating under VAT registration number 977252386 (Old Villa).
The terms and conditions contained on this website (www.oldvilla.co.uk URL) apply to all transactions carried out on the website (the Terms and Conditions).
Unless otherwise defined, references to us our the Company and we shall be deemed to be references to Old Villa and references to you and your shall be deemed to be references to any person placing and order or carrying out any other transaction on this website.
ORDERING
Once an order has been completed on this website, you will be deemed to have offered to purchase the relevant product at the price (including any delivery or other charges) and quantities indicated. At the point of placing the order you will be deemed to have read, understood and agreed with the Terms and Conditions.
Once the order is placed secured payment will be required and you will receive an automatic email thanking you for your custom. Old Villa will issue a more detailed confirmation email of the order within 24 hours of receiving an order to acknowledge the order and confirm that the goods will be dispatched accordingly (the Confirmation Email). Subject to the terms under the paragraph below headed MISTAKES, Old Villa shall only be bound by the order when it has issued a Confirmation Email and at this time a contract between you and Old Villa shall be made.
Occasionally a product may be out of stock, if this is the case we will inform you via the Confirmation Email and advise if and when the product will become available. Where a product is no longer available you will have a right to cancel your order and we will provide you with a full refund.
Any product ordered will remain the property of Old Villa, until full payment has been received and the order dispatched. Once payment has been received and the product is dispatched ownership will transfer to you.
CANCELLING AN ORDER
You may cancel an order once placed and accepted by us, at any time up to dispatch. To inform us of a cancellation, please send us an email or letter.
PAYMENT
We accept all major credit and debit cards and all payments on the website are made in a secure environment. Any credit or debit card presented for payment will be deemed to belong to the person using it.
In the event that the issuer of the card refuses to validate a transaction and authorise payment to us, we will be forced to cancel the order. Where an order is cancelled due to the failure of an issuer to authorise payment to us, we will inform you of this in the Confirmation Email.
TAXES
All prices quoted on this website are inclusive of the United Kingdom sales tax, which is currently 20% (VAT).
All orders dispatched to destinations outside the European Union (EU) will be free from a sales tax. Orders dispatched to a EU country will include VAT.
Please note there may be additional customs and or import duties payable once a package has reached its destination. We do not accept responsibility for any such duties payable and you will be liable to make any such payments.
PRICING
All prices quoted on this website are in pounds sterling, inclusive of VAT (the Price of a Product) and are subject to change without notice.
The Price of Product is exclusive of delivery costs, which vary (please see the paragraph on DELIVERY below).
For prices relating to Special Offers and Sales, please see the paragraph headed SPECIAL OFFERS AND SALES below.
AVALABILITY AND CONFORMITY OF PRODUCTS
All descriptions and specifications of products on the website are carefully considered and are correct when put on the site. However, such descriptions and specifications are not binding and are intended to generally describe the products and we do not give any warranty as to the accuracy or completeness. Please note that whilst we take care to ensure that the colouring of products on the site are as accurate as possible, in some instances browser software or computer system used by you may cause some variations in colour. We do not accept responsibility for any such variations.
If readily in stock, products will be dispatched following the Confirmation Email, generally within 24 hours. Where products are not currently in stock or there is some other delay with delivery, you will be informed via the Confirmation Email, within 24 hours of your placing the order. In the event that the delay in delivery occurs following the Confirmation Email, we will inform you as soon as possible. Furniture and other made to order items will be delivered in accordance with the delivery terms below.
We will endeavour to keep you informed at all times on the status of your order where there is a delay, however we are not liable where any delay or failure in delivery is beyond our control.
DELIVERY
Standard Delivery costs £5 per delivery address in the UK Mainland and applies from Monday- Friday only. Allow 7 working days for delivery.
Next Day Delivery costs £10 per delivery address in the UK Mainland and applies from Monday Friday only. All orders must be received by us no later than 12 noon for next day delivery.
Weekend Delivery costs £10 per delivery address in the UK Mainland and applies to Saturday only. All orders must be received by us no later than 12 noon on Thursday.
International postage is charged at cost, please contact us at info@oldvilla.co.uk for further details or to place an order.
Furniture and other heavy items please call us for all queries on delivery of furniture before placing an order on line. The cost is approximately £50 per delivery address within the M25 of London. For deliveries outside the M25 of London please contact us for further details as there will be an additional charge. Please allow up to 8 weeks for delivery in the UK and up to 12 weeks for international delivery.
SPECIAL OFFERS AND SALES
All special offers and sales are made subject to the Terms and Conditions, unless expressly stated otherwise in the terms of the special offer. Where there are additional terms and conditions in relation to a special offer (the Additional Terms and Conditions), the Terms and Conditions shall be supplemental to such additional terms and conditions.Where there is conflict between Additional Terms and Conditions and the Terms and Conditions, the Additional Terms and Conditions shall supersede.
The Old Villa website has a "Specials" section where products are offered at a discounted price the Additional Tems and Conditions relating to the Specials are as stated on the website.
Old Villa will have periodic sales twice a year and occasional special sales such as an Easter Bonaza or Mothers/Father's Day special offers, where products will be offered at a discounted price for a period of time ("Sales"). These Sales will have promotion codes attached to them. The prices quoted on the website are the full prices and do not reflect any Sales that may be in operation at any given time. You will be promted to insert a promotion code at Checkout in order to benefit from the Sale. All promotion codes relating to a Sale will be clearly displayed on the Home page of the website for the period of the Sale. We will not be responsible or liable should you fail to insert the promotion code and consequently do not enjoy the benefit of the Sale.
Unless otherwise stated, products in the Specials and New section of the on line shop will not be part of the Sales.
Occasionally we may run special offers in conjuction with other organisations or companies or offer you opportunities for special promotions with such organisations or companies. Please note that the terms and conditions of the relevant organisations or companies will apply in those cases and we are not liable for grievance you may have in relation to such offer or promotion.
COMPETITIONS
Old Villa may occasionally run competitions either on the Old Villa website, via the quarterly e-magazine or the mail order catalogue (the Competition). Each Competition will have its own additional and separate terms and conditions (the Special Competition Terms and Conditions) that will appear with the Competition. The terms and conditions contained in this paragraph of the Terms and Conditions, should be read in conjunction with the Special Competition Terms and Conditions. In the event of conflict between the Terms and Conditions and the Special Competition Terms and Conditions that later shall prevail.
The period of the Competition will be clearly stated in the Special Competition Terms and Conditions, as will the closing date for entries. Unless otherwise specified, the Competition is open to United Kingdom and Republic Of Ireland residents aged 18 or over, except employees of Old Villa and their associated, affiliated or subsidiary companies, and their families, agents, or any other person(s) connected with the Competition, including third party promotional partners.
Entry to any Competition is limited to one per person and the winner is responsible for ensuring they are able to accept the prize as set out and in accordance with these Terms and Conditions and the Specific Competition Terms and Conditions, in the event they are unable to do so then Old Villa reserves the right to redraw the prize.
Unless otherwise stated, entry to the Competition is free but entrants should be aware that they may be subject to local call charges depending on their own individual arrangements for Internet access.
An eligible entrant must be an individual and must satisfy the entry conditions of the Competition as set out in these Terms and Conditions and the Specific Competition Terms and Conditions. By entering, all eligible entrants agree to abide by each and all these Terms and Conditions and the Specific Terms and Conditions. Misrepresentative or fraudulent entries will invalidate an entry. Old Villa reserves the right, with or without cause, to exclude entrants and withhold prizes for violating any of these terms and conditions. Old Villa reserves the right to amend these terms and conditions. Any amendments will be published on the Old Villa website.
The prizes for the Competition will be stated clearly in the Specific Competition Terms and Conditions. Winners will be notified within fourteen (14) days after the closing date. All reasonable endeavours will be made to contact the winner during this time. If a winner cannot be contacted or is not available, Old Villa reserves the right to re-draw another winner from the correct entries which were received before the closing date.
Unless stated otherwise in the Specific Competition Terms and Conditions, there is no cash or other alternative to the prize stated and the prize is not transferable and no part or parts of the prize may be substituted for other benefits, items or additions.
Winners may be required to submit valid identification before receiving their prize.
Old Villa's decision on the winners of a Competition is final and binding on the entrants. No correspondence will be entered into.
Old Villa will not be liable for technical, hardware, or software failures of any kind or lost or unavailable network connections which may limit or prohibit an eligible entrant's ability to participate in the competition.
Uses of personal data received by Old Villa in the course of the Competition are subject to the privacy policy contained in these Terms and Conditions. Winners' names may be published on the Old Villa website, newsletter or mail order catalogue.
The act of entering the Competition will be deemed acceptance of these Terms and Conditions and the Specific Competition Terms and Conditions.
Old Villa reserves the right at any time to cancel, modify or supersede the Competition (including altering prizes) if, in their sole discretion, a Competition is not capable for being conducted as specified. Old Villa reserves the right to substitute a prize of equal value in the event that circumstances beyond their control make this unavoidable.
RECOMMEND A FRIEND AND WIN A GIFT
The Old Villa "Recommend a Friend and Win a Gift" is a special on going promotion. Where an exisiting customer recommends two or more friends who then go on to purchase items on the Old Villa on line shop, we provide the customer with a choice of three gifts. The customer must provide evidence of the friends recommedned and their purchases. This promotion may only be used once by an existing customer and we reserve the right to end the promotion at any time without notice.
GIFT VOUCHERS
The Old Villa gift vouchers are available to purchase on the website and are valid for 3 months from the purchase date. The minimum amount you can purchase is £10. Once purchased they cannot be returned in exchange for cash and cannot be refunded. Gift vouchers are valid to use for purchasing any item on the website or instore, unless otherwise stated. Gift vouchers cannot be used as currency on the website to purchase items. Please contact us at info@oldvilla.co.uk or on 0208 299 6966 to use the gift voucher or visit us in store. A credit note will not be provided for any unused amounts on gift voucher under £5.
CELEBRATION LIST
All products placed on a Celebration List are subject to the Old Villa Terms and Conditions. Placing a product on a Celebration List does not guarantee that it will be available when you or your friends and family are ready to purchase it. We will not be responsible if any product on a Celebration List sells out prior to it being purchased. You are welcome to call us to confirm the availability of the products you are particularly interested in for a Celebration List and to enquire as to the possiblilty of re-ordering such items in the future. We will try our best to advice and facility you in this situtation.
Celebration Lists created on the website will remain valid for 4 months. Due to the seasonal nature of some of the products, a Celebration List which remains active for more than 4 months runs the risk of not having current stock on it.

RETURNS
We are happy to offer a replacement or provide a full refund if for any reason you are unsatisfied with your purchase once received, provided that you notify us of your intention to return the product within 7 days of purchase and the product is actually received by us within 28 days of purchase. Any items returned must be in its original packaging and in perfect condition. We will be unable to accept any items that are worn, soiled, washed or used in any way.
All returns must be sent to us at the address below, together with a completed Returns Card (included with the package). Please state clearly on the Returns Card your reason for the returning the item and whether a refund or replacement is required. You will be required to bear the cost of returning products to us (unless it is faulty, in which case we will refund you the cost of returning it to us) and until the product is received by us, it will remain you property and you will bear the risk. We would therefore advice that you return all items by registered post for your own protection.

For returns of furniture and other very heavy items please contact us prior to sending the item to let us know when to expect it.This is to ensure that the item will be handled correctly once delivered to us and we can look out for it.
WITHDRAWL OF PRODUCTS
We reserve the right to withdraw a product at any time. The circumstances for withdrawing a product differ and whilst we will try to ensure that this does not happen on a frequent basis, we are not liable to any person for any such withdrawal of products. Where an order has been placed prior a withdrawal and before dispatch we will offer a full refund or exchange for an equivalent product.
MISTAKES
We do our very best to ensure that all information provided on this website is accurate. However in that event that a mistake is made with regards to product pricing, description or availability, we reserve the right to cancel any orders placed where there has been such a mistake. We shall inform you of any such cancellation in the Confirmation Email (please see the paragraph on ODERING above).
DISCLAIMER

While we take great care to ensure that all information posted on the site is correct at the time of posting we will not be responsible for any errors or omissions or for the results arising from the use of such information.
